EverJoy Privacy Policy

Effective Date: July 1, 2026
Last Updated: July 2026
Version: 2026-07
Entity: EverJoy Memory LLC, a [TODO: State of incorporation — confirm with counsel] LLC ("EverJoy," "we," "us," or "our")

1. Introduction and Scope

This Privacy Policy ("Policy") describes how EverJoy collects, uses, discloses, retains, and protects information when you access or use the EverJoy platform at myeverjoy.com and related websites, mobile experiences, APIs, and services (collectively, the "Service").

EverJoy is The AI-Powered Student Growth Cloud — a platform that helps parents and legal guardians preserve, organize, and celebrate childhood memories from Pre-K through graduation. The Service includes memory storage, growth timelines, digital Personalized Yearbooks, optional AI-powered insights and recommendations, Family Circle sharing, and—at participating schools—the Partner Capture Network for school-based scanning of student work using Student ID Booklets.

This Policy applies to:

EverJoy is designed as a parent-directed service. We do not knowingly provide accounts directly to children under 13, and children do not log into the Service independently. All Child Profile data is controlled by the Parent or legal guardian who created or authorized the profile.

By creating an account, using the Service, or providing consent during onboarding, you acknowledge that you have read and understood this Policy. If you do not agree, do not use the Service.

2. Information We Collect

We collect information in the categories below. The specific data collected depends on how you use the Service (parent uploads, partner school scanning, subscription tier, AI consent, etc.).

2.1 Account and Profile Information (Parents/Guardians)

When you register, we collect:

We use Supabase Auth for identity management. Your email must be verified before accessing dashboard features.

2.2 Child Profile Information

When you create or activate a Child Profile, we collect information you provide or that is matched through school roster activation:

Important: At partner schools, roster matching uses date of birth server-side only. Parents cannot directly query or browse school roster records.

2.3 Memories and User Content

You may upload or have captured on your behalf:

For content captured through the Partner Capture Network, scanned artifacts may include images of student work with EverJoy Student ID labels. Student identity is determined exclusively through QR/barcode scan—not through handwriting recognition or OCR-based identity inference.

2.4 AI-Generated and Derived Data

When you provide separate consent for AI processing (ai_processing consent, version 2026-07), we may generate and store:

AI outputs are stored as part of your Child Profile data and are subject to the same access controls as the underlying memories.

2.5 Consent Records

We maintain immutable records of consents you provide, including:

Consent records are retained for compliance purposes and are not hard-deleted when you revoke consent; we record the revocation event instead.

2.6 Billing and Transaction Information

Subscription billing is processed by Stripe. We receive and store:

For one-time purchases (professional Student ID Booklets at $9.99 initial / $4.99 replacement), Stripe processes payment; we store transaction references.

We do not store full credit or debit card numbers. Card data is handled directly by Stripe in accordance with PCI-DSS requirements.

2.7 Usage and Analytics Data

When analytics are enabled, we use PostHog to collect:

We configure analytics to minimize collection of Child Profile content in analytics events. Analytics data is used to improve the Service, not to sell personal information.

2.8 Communications Data

When we send transactional emails (account verification, billing receipts, consent updates, security notices), our email providers Postmark (primary) and SendGrid (fallback) process recipient email addresses and delivery metadata.

2.9 Support and Correspondence

If you contact support@myeverjoy.com or partners@myeverjoy.com, we collect the content of your communications and associated account identifiers to respond to your inquiry.

2.10 Information We Do Not Collect

3. How We Use Information

We use collected information for the following purposes:

3.1 Provide and Operate the Service

3.2 AI Features (With Parent or Guardian Consent)

When AI features are enabled and you have given the applicable consent, EverJoy uses a third-party AI provider, currently OpenAI, to help classify, extract text from, summarize, and organize your child's uploaded and captured content, and to prepare parent-facing growth and yearbook suggestions.

What AI may do, what it is not intended to do, and how consent works are described in the AI Usage & Transparency Policy.

When AI features are enabled for the Service, that consent is required before the family dashboard can be used. Confirming the consent checkbox records your choice in the product. The checkbox is not, by itself, a statement that every method of verifiable parental consent required by COPPA or another law has been completed.

3.3 Billing and Account Management

3.4 Security, Compliance, and Fraud Prevention

3.5 Communications

3.6 Improve the Service

Partners are independent contractors subject to certification, FERPA/COPPA training, and contractual confidentiality obligations. They do not receive parent contact information except as necessary for booklet delivery logistics.

4.3 Family Circle Members

When you invite family members to your Family Circle, they may view Memories and content you explicitly share, subject to Family Circle privacy rules. Invited members cannot modify Child Profiles or billing settings unless you grant additional permissions.

7.1 What Information May Be Processed

When AI features are enabled and you have given the applicable consent, EverJoy may transmit to its AI provider the categories listed in the AI Usage & Transparency Policy. Those categories include uploaded artifacts, text from those artifacts, titles and descriptions, relevant dates, and the limited child or school-year context a specific task needs. EverJoy seeks to send only what that task reasonably needs.

7.2 Your Controls

7.3 Provider Training

EverJoy does not intentionally provide children's information to its AI provider for the purpose of training that provider's general-purpose models, and it does not voluntarily opt that information into a provider training program. Provider terms can change. Review the provider's current terms and Section 9 of the AI Usage & Transparency Policy.
